OPM Issues Implementation Guidance for Land Management Workforce Flexibility Act

Last year Congress passed legislation that would make temporary employees of federal land management agencies eligible to compete for permanent competitive service positions.

The legislation applies to temporary seasonal “1039” employees with the U.S. Forest Service (USFS), Bureau of Land Management (BLM), National Park Service (NPS), U.S. Fish and Wildlife Service (USFWS), Bureau of Indian Affairs (BIA), and the Bureau of Reclamation.

The President signed the legislation into law (P.L. 114-47) in August, and prior to the end of the year the Office of Personnel Management (OPM) issued implementation guidance to agencies.

OPM will issue regulations at 5 CFR 315 and 335 to implement the provisions of the law, but in the meantime has published a list of frequently asked questions with answers.
